TERMS & CONDITIONS
1. Definitions
- OnlineTicketExpress: is a trading name of a private company with limited liability.
- Ticket: admission ticket for an event.
- Client: the person who concludes an agreement with OnlineTicketExpress Express to provide
tickets (admission tickets) for events such as sport (football, rugby, formula1,
etc), concerts, theatre, etc.
- By writing: a letter put down on paper as well as a message that has been
prepared and defined electronically.
- Booking confirmation: a written confirmation provided by OnlineTicketExpress of the
booking placed by the client regarding a booking that is sent by OnlineTicketExpressto the e-mail address specified by the client.
2. Applicability
A. By visiting, using or ordering from this website, the client expressly agrees to
be bound by the following Terms and Conditions and to adhere to these Terms and
Conditions and all applicable laws and regulations governing this website.
B.
These Terms and Conditions shall apply to all orders, booking confirmations and
agreements where OnlineTicketExpress acts as the seller of tickets. Additions to or
deviations from these Terms and Conditions shall only apply if accepted by
writing by OnlineTicketExpress. No rights can be derived from any promises made by
any OnlineTicketExpress employee unless they have been confirmed by writing by OnlineTicketExpress.
C. General Terms and Conditions of clients/customers shall not apply
unless their applicability has been accepted explicitly by writing by OnlineTicketExpress.
D. If the client breaks these Terms and Conditions, OnlineTicketExpressreserves the right to prevent his future use of this website, cancel his order
request, and/or take appropriate legal action against him.
E. OnlineTicketExpress reserves the right to change these Terms and Conditions
at any time. Posting updated terms on this website will make these terms
effective immediately and binding on all users of this website without
exception. Therefore, please check this website periodically for updates.
F. As event tickets are purchased in a free and fluctuating market,
ticket prices are subject to change at any time. For up-to-date, current prices,
the client must call or consult OnlineTicketExpress website.
3. Agreement conclusion
A. OnlineTicketExpress offer shall be deemed to have been accepted by the
client should said client has specified on the OnlineTicketExpress booking procedure
which ticket(s) said client wishes to receive as well as having filled in the
other information and this booking has been received by OnlineTicketExpress after it
has been sent.
B. A client shall also be deemed to have a OnlineTicketExpress offer accepted
if said client has passed on the required information through the phone to OnlineTicketExpress .
C. An agreement shall be concluded once OnlineTicketExpress has confirmed the
client's acceptance of an OnlineTicketExpress offer through an order/booking
confirmation by writing. OnlineTicketExpress shall not be obliged to conclude an
agreement and can decide not to conclude an agreement at its own discretion.
D. All orders are binding for the client and cannot be cancelled without
written acceptance of cancellation by OnlineTicketExpress.
4. Prices
A. When
booking the client expressly accepts the difference in price over ticket face
value, due to changes in supply and demand, the degree of difficulty, the cost
of obtaining and most important, the cost involved in servicing and delivering
tickets to the client’s position.
OnlineTicketExpress prices will be different from the prices that may be specified on
the tickets themselves and the client cannot derive any rights from these. All
costs are included in OnlineTicketExpress prices excluding handling fee costs.
B. Prices are expressed in Euros or GBP unless otherwise specified.
5. Payment
A. All packages and ticket bookings offered are subject to availability.
B. All ticket prices are guaranteed at the time an order is placed, and
payment is received.
C. Accepted forms of payment are credit card (Visa, MasterCard) or bank
transfer. OnlineTicketExpress reserves the right to ask client to pay only by bank
transfer.
D. Full payment must be received in order to guarantee a ticket purchase.
E. Price paid is the price shown on the website at the date and time of
booking and accepted by the client when confirming the purchase while ordering
on the website. All payments will be taken in Euro, even if the original price
on the website is in GBP. (all events where the original price is shown in GBP
will also show the total order's amount in Euros, as well as on the email
confirmation).
F. OnlineTicketExpress charges will also appear on the client's credit card
statement under the name of "OnlineTicketExpress".
G. Credit card payments must be verified by the credit card company
(online) or the order will automatically be cancelled.
H. OnlineTicketExpress reserves the right to security check all orders and may
request that proof of client's I.D and copy of the credit card would be sent to
OnlineTicketExpress. (The order will be cancelled if the I.D or copy of the credit
card is not received by OnlineTicketExpress).
I.
No changes, cancellations or refunds would be made once the purchase has been done and accepted by OnlineTicketExpress.
As appear in the European law number 31997L0007, DIRECTIVE 97/7/EC (May 20, 1997) on the protection of consumers in respect of distance contracts. It is written clearly that once a client submit a booking for transports (flight, bus, etc) or accommodations (hotels, apartments, etc) or catering or leisure services or leisure events (tickets), the client can´t cancel the booking. In case of cancelation by the client will not be any refund.
6: Delivery of tickets
A. By finishing the order, the client is asking and giving automatically
authorization to OnlineTicketExpress to ship the client tickets by courier company as
OCS, Royal Mail, FedEx, UPS, DHL or OnlineTicketExpress own courier.
B. Shipment and issue shall be at the expense and risk of the client.
Shipment costs are also applicable to hotel delivery and pick up of the tickets.
C. Tickets shall be sent at the expense and risk of the client via FedEx or a similar courier. Shipments by FedEx or any local courier service are not insured. OnlineTicketExpress cannot be held liable for any damage that should be done by FedEx or any other courier company like lost, late delivery and/or misplaced tickets.
D. Should the client or the client’s hotel don't accept the ticket and so
the ticket is returned to OnlineTicketExpress by FedEx or any local courier service,
the client shall be deemed to be waiving his right to delivery. The client shall
be obliged to compensate OnlineTicketExpress for the costs incurred in relation to
the return shipment.
E.
Normally tickets are shipped from OnlineTicketExpress offices 3 - 5 days before the
event (subject to changes).
F. Should a delivery window won't be available (due
to the late release of some tickets)
or by client request, tickets will be sent to some hotel address or local pick
up address near to the event,
on the day of the event.
In case of pick up point near to the event, OnlineTicketExpress will start to deliver
the tickets 2 hours before the event time till the starting of the event (in
case of pick up point near to the event, if the client doesn't arrive to collect
his tickets, no refund will be made).
G.
Most sport and football tickets (Premier League, Serie A and Spanish League)
will be delivered to the client's hotel 1 or 2 days before the event takes
place. To that extend, the client must provide OnlineTicketExpress with his hotel
details.
In case of hotel delivery, the client will be solely responsible for receiving
the tickets from the courier. If for any reason his hotel refuses to receive
the tickets from the courier, the client will be solely responsible (OnlineTicketExpress recommends the client to inform his hotel about the tickets delivery).
For specific and precise information about the shipment please contact OnlineTicketExpress sales team nearest to the time of the event.
H. The client is obliged to inform OnlineTicketExpress of any changes in the
address where tickets can be delivered up to 72 hours before the event. (Any
consequences due to changes informed in less than 72 hours before the events
will be under full responsibility of the client).
I. OnlineTicketExpress will not be responsible for any undelivered tickets
based on misinformation related to the mail address given by the client (in this
case the client will be responsible for undelivered tickets - no refund will be
made).
7. Tickets
A. The client authorizes OnlineTicketExpress that in case will be available
only tickets in higher category than the one he ordered, OnlineTicketExpress will
supply to the client tickets in higher category and will charge him for the
extra amount of money related to the difference between the categories of each
ticket.
B.
For each event OnlineTicketExpress can supply to the client a match day ticket or a
season ticket (card). If the client receives the season ticket (card), he can
use this season ticket only for the specific date and event that he had booked.
Once the event ended, the client must send back immediately the season ticket
(card) to OnlineTicketExpress based on the instructions he will get from OnlineTicketExpress or from OnlineTicketExpress supplier. These instructions can be given by
phone or by letter attached to the season ticket (card) inside the envelope.
Client staying in a hotel (at the event city) will leave the season tickets at
the same night after the end of the event inside an envelope at the hotel front
desk and will write on the envelope the name of OnlineTicketExpress or other name
based on the instructions he will receive.
If the client doesn't return the season ticket (card) within the 24 hours after
the event, OnlineTicketExpress will charge the client £100 (GBP) for each season
ticket (card) for each day (starting from the end of the 24 hours after the
event till returning the season ticket back to OnlineTicketExpress offices).
C. The client, by confirming that he agrees to the Terms and Conditions
when he places the order, agrees
that the tickets for sport events, rugby matches or football matches in each
category can be in any home or away section. The client also agrees that he will
not have any claim against OnlineTicketExpress regarding the home or away ticket. For
any kind of tickets (home or away) the client must act and wear as stated on the
ticket or by the organizers. For the home team sections the client may not be
allowed to enter the venue in case he wears clothes in support of the
visiting team as well as for the visiting team sections the client may not be
allowed to enter the venue in case he wears clothes in support of the home team.
Doing so is therefore at the client own risk and no refund will be made.
8. Special provisions and liability
A. When the occasion arises and in particular in relation to music and/or
sport events, tickets may display a name that does not match the name of the
client or user of the ticket. OnlineTicketExpress cannot be held liable should the
client and/or the user of a ticket not be granted access to the event and/or he
(and/or the person for who said client has bought the ticket) is denied access
as a consequence of this.
B. The client and/or the user of a ticket supplied by OnlineTicketExpress must
behave as a good and orderly visitor of events and must follow instructions
given by or due to the organizer of an event to be visited by said client and/or
user as well as by the competent authorities.
C. OnlineTicketExpress shall not be held liable should organizers of an event
or the authorities eject the client from the venue due to the purchase of the
tickets in the second market. By purchasing tickets on this website, the client
agrees and accepts that he buys tickets in the second market and not from any
official box office related to the official organizers, and so the client will
be full responsible for this action. If the client is ejected from any venue in
United Kingdom due to the contravention of section 166 on Criminal Justice and
Public Order Act 1994, he agrees to be full responsible for this action and for
buying the tickets through OnlineTicketExpress. The client agrees that in this case
he will not have any claim against or demand from OnlineTicketExpress so he will not
get any refund.
D. OnlineTicketExpress shall not be held liable should organizers of an event or the
authorities deny admission to the client and/or user of a ticket delivered by
OnlineTicketExpress to an event except insofar in the case of an intentional act or
omission or gross negligence of OnlineTicketExpress.
E. The client and/or user of a ticket shall visit an event at his own
risk. OnlineTicketExpress shall not be held liable for damages (also in cases of
undelivered tickets by OnlineTicketExpress) that the client and/or user may suffer
while travelling from or to the event or attending such an event.
F. The options of categories stated by OnlineTicketExpress for tickets shall
not harmonies with any categories used by the organizer of the event for which
the tickets have been issued. The client cannot derive any rights from the
category class and/or ranking.
G. The Client and/or user of a ticket supplied by OnlineTicketExpress must
obtain information himself in relation to instructions given by or on behalf of
the organizer of the event or the authorities as well as to any changes related
to the event such as starting times and similar. OnlineTicketExpress shall not have
any obligation to further inform the client and/or user of the ticket regarding
this.
H. Events that have been cancelled or moved are at the expense and risk of the client and cannot be regarded in any way as a shortcoming of OnlineTicketExpress. OnlineTicketExpress shall not be liable to pay for compensation. The client himself is responsible to get the information about the correct dates and starting time of concerts and events and also to note that football matches can be rescheduled to fit into Champions League obligations and/or television coverage. These changes can take place at very short notice. OnlineTicketExpress recommends the client to make both Saturday and Sunday available when arranging his travel plans and to ask his hotel's concierge or check the official websites or even the local press for the exact schedules upon arrival.
I. Should
an event be cancelled and should a replacement event not takes place, the client
must not approach OnlineTicketExpress but the organizer of the event in order to be
refunded the original value of the ticket if possible. Should a replacement
event takes place, the client must approach the organizer of the event should
said client will not be able to be present at the replacement event in order to
be refunded the original value of the ticket if possible.
J. The content of the OnlineTicketExpress website is without obligation and
the client cannot derive any rights towards OnlineTicketExpress in relation to the
content thereof and the included links.
K. OnlineTicketExpress prices are subject to fluctuations related to the
demand for and the availability of tickets. The client cannot derive any rights
from increases or reductions of prices once the client has accepted OnlineTicketExpress offer.
L. Any liability of OnlineTicketExpress shall be limited to the amount that
the client has paid for the ticket involved.
M. Lost, stolen or damaged tickets cannot be duplicated.
9. Force majeure
A. Shortcomings in relation to the execution of the agreement cannot be
attributed to a party should these not be due to the fault of the party or when
said party cannot be deemed responsible for them in accordance with the law, the
agreement or according to generally accepted standards.
B. OnlineTicketExpress can invoke force majeure should the OnlineTicketExpressshortcoming be partly or fully the result of war, mobilization, riots, flooding,
fire, accidents, strikes, occupations, and measures set by the government,
non-delivery of required tickets to OnlineTicketExpress by third parties and other
unforeseen events.
10. Brochure (Web) of OnlineTicketExpress
The information stated in the brochure is subject to changes due to price
changes and/or errata. Amounts mentioned on the website are based on prices,
exchange rates, duties and taxes as they are known by OnlineTicketExpress at the time
of its printing.
11. Information from and about OnlineTicketExpress
A. OnlineTicketExpress is a commercial company specialized in offering tickets
for sold-out and/or popular events and for so-called hard-to-get tickets.
B. OnlineTicketExpressobtains tickets on the secondary market and the prices listed on this website
reflect the degree of difficulty in obtaining these tickets. OnlineTicketExpress is
not connected to any box office, or sponsored by any of the venues, teams,
performers or organizations whose tickets this website provides.
